The Division of Health Care Access and Improvement (HCAI) is a multi-faceted Division, comprised of exciting and innovative programs that promote availability of quality health care services in New York City, including: Primary Care Access and Planning which develops policies, surveillance and programs around access to primary care; the Primary Care Information Project which is a nationally recognized program that supports the adoption and use of Electronic Health Records (EHRs) among primary care providers; and the Correctional Health Services Program which provides medical and mental health care and discharge planning to more than 90,000 patients per year in the cityâs correctional facilities. This is a fast paced, team-oriented environment that works on healthcareâs most challenging and complex problems.
The Executive Agency Counsel, MI /Senior Attorney will support the Division leadership ensuring that the programs successfully address legal hurdles and challenges, and are aware of current and prospective legal reforms that may impact their strategic planning and operations. The Senior Attorney will also provide direct support to the Correctional Health Services program in achieving compliance with all Court Ordered Stipulations, laws, and regulations. The Executive Agency Counsel, MI /Senior Attorney will be the in-house expert on the legal requirements and Stipulations governing Correctional Health Services, and will work very closely with the various programs, including the Forensic Bureau Health Services program and the Mental Health program staff to ensure compliance. This will require the Executive Agency Counsel/Senior Attorney to spend time in the field (e.g. Rikers Island and borough jails), meeting with staff, observing their performance, and helping to facilitate and coordinate activities with a focus on compliance.
The Executive Agency Counsel/Senior Attorney will also work closely with the HCAI Leadership team and the Correctional Health Services Leadership team, including QA auditing teams, to ensure that there are thorough reviews and analysis of programmatic activities. The Executive Agency Counsel/Senior Attorney will work to follow up on internal audit findings of non-compliance and work with staffing at all levels to ensure that there is corrective action following any auditing of the programs. The position will also require the development of specific follow actions as needed. The Executive Agency Counsel/Senior Attorney may also be required, from time to time, to assist with other legal projects, such as drafting contracts, reviewing and analyzing legal and programmatic documents submitted by HCAI contractors, preparing legal opinions affidavits, memoranda, and other legal papers for the Division Counsel and Deputy Commissioner that will form the basis for policy recommendations by the Division. Participating in inter-agency workgroups and committees. Other responsibilities include: reviewing pending legislation affecting HCAI programs and drafting proposed legislation or regulations, advising HCAI staff on issues of contract interpretation, performance evaluation/or program policies, assisting with ongoing litigation, and performing other related legal matters as needed.
Minimum Qual Requirements
Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, eighteen months of which must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant legal work.
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
Preferred Skills
Candidate should have a minimum of 5 years of legal experience. Knowledge of administrative law, healthcare, healthcare policy, and compliance programs is preferred. Familiarity with public sector and correctional settings would be helpful. Candidate should have experience managing staff and be able to demonstrate a track record of successful leadership, a strong sense of urgency and a passion for getting results.
